Terms of Service
Effective Date: 2026-05-10
These Terms of Service (“Terms”) govern your access to and use of proxivalabs.com (the “Site”) operated by Proxiva Peptides (“Proxiva,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms.
1. Research-Only Use — Critical Disclaimer
All products sold on this Site are intended strictly for laboratory and research use only. They are not for human or animal consumption, medical use, diagnostic use, therapeutic use, or veterinary use. By placing an order, you certify that:
- You are purchasing for laboratory, scientific, or research purposes only.
- You will not administer, ingest, inject, apply, or otherwise consume the products.
- You will handle all products in compliance with all applicable laws and institutional protocols.
- You assume full responsibility for the lawful use of any product purchased.
Proxiva makes no representation that any product is safe, effective, or appropriate for human or animal use. Any use other than laboratory and research use is strictly at your own risk and is not authorized by Proxiva.
2. Eligibility
You must be at least 18 years old (or the legal age of majority in your jurisdiction) and capable of entering into binding contracts to use the Site or place orders. By using the Site, you represent that you meet these requirements.
3. Account and Order Acceptance
You agree to provide accurate, current, and complete information when creating an account or placing an order, and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
All orders are subject to acceptance by Proxiva. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, product unavailability, or any reason we deem appropriate. If we cancel an order after payment, we will refund the charged amount.
4. Pricing, Payment, and Taxes
Prices listed on the Site are in U.S. dollars and are subject to change without notice. We accept payment via the methods listed at checkout, including credit/debit cards (via Stripe), Bridge Payment Gateway (cryptocurrency), Zelle, and other methods we may offer from time to time.
You are responsible for any taxes, duties, or fees imposed by your jurisdiction. We may collect sales tax where required by law.
5. Shipping and Delivery
We ship from our United States facility via USPS or FedEx. Delivery times are estimates only and not guaranteed. Risk of loss and title pass to you upon delivery to the carrier. Tracking information will be provided.
You are responsible for providing an accurate shipping address. Shipments returned due to incorrect addresses or refused delivery may be subject to reshipment fees.
6. Returns and Refunds
Due to the nature of research compounds, all sales are final once a product has shipped. We do not accept returns or issue refunds for opened, used, or partially-used products.
If your shipment arrives damaged or defective, contact us at in**@*********bs.com within 7 days of delivery with photographic evidence. We will, at our discretion, replace the affected items or issue a refund.
Lost shipments confirmed by the carrier as undeliverable may, at our discretion, be re-shipped or refunded.
7. Prohibited Conduct
You agree not to:
- Use the products for human, animal, medical, therapeutic, diagnostic, or veterinary purposes.
- Resell, distribute, or advertise our products for any non-research use.
- Make false claims about the products’ safety, efficacy, or intended use.
- Reverse-engineer, scrape, or harvest content from the Site without our prior written consent.
- Use the Site or products in violation of any applicable law or regulation.
8. Intellectual Property
All content on the Site — including text, graphics, logos, product photography, and the Proxiva name and marks — is the property of Proxiva or its licensors and is protected by U.S. and international intellectual-property laws. You may not reproduce, distribute, or use our content without prior written permission.
9. Disclaimer of Warranties
The Site and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or any warranty arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, error-free, secure, or that any defects will be corrected.
10. Limitation of Liability
To the maximum extent permitted by law, Proxiva and its officers, directors, employees, affiliates, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to the Site, the products, or these Terms — even if advised of the possibility of such damages.
Our total liability for any claim arising from or relating to the Site, the products, or these Terms is limited to the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Proxiva and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the products in violation of these Terms, including any human or animal use.
12. Governing Law and Venue
These Terms are governed by the laws of the United States and the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
